By accessing the Employment Research Group (hereinafter "ERG") website and/or purchasing ERG products or services, you acknowledge that you have read and agree to abide by the following Terms and Conditions:

1. Registration. When you register an account, you agree to
  1. use the site and any purchased ERG products for lawful purposes only;
  2. provide true, accurate, current, and complete information about yourself as prompted by our registration form (including your email address); and
  3. maintain and update your account information (including your email address) to keep it true, accurate, current, and complete. You acknowledge that if any information provided by you is untrue, inaccurate, not current, or incomplete, we reserve the right to terminate your account.
As part of the registration process, you will be asked to select a username and a password. If you have reason to believe that your account with us is no longer secure, you must promptly change your password by updating your account information and immediately notify us of the problem by emailing us at privacy@employmentresearchgroup.com. You are entirely responsible for maintaining the confidentiality of your username and password and entirely responsible for any and all activities (including purchases, as applicable) that are conducted through your account.

2. Purchasing
If you wish to purchase products or services described on the ERG website, you will be asked to supply certain information applicable to your purchase, including, without limitation, credit card and other information. You understand that any such information will be handled by ERG in the manner described in our Privacy Policy. You agree that all information that you provide to ERG will be accurate and complete. You agree to pay all charges incurred by you or any users of your account and credit card or other payment mechanism at the price(s) in effect when such charges are incurred. You will also be responsible for paying any applicable taxes relating to your purchases. We reserve the right, without prior notification, to change such descriptions or references. Verification of information may be required prior to ERG's acceptance of any order. Price and availability of any product or service are subject to change without notice.

3. Payments
All charges are shown in U.S. dollars. Payments are to be made in U.S. dollars. ERG accepts the following types of payment:
  • Check or Money Order
  • Credit Card (VISA, MasterCard, American Express, Discover)
4. Risk of Loss
All merchandise purchases from ERG that require shipping are made pursuant to a shipping contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier. ERG may in its discretion offer a replacement under the terms of the company's return policy.

5. Returns
We want to make sure that you are completely satisfied with your purchase. Because of the nature of the products we offer, ERG does not offer refunds for any products once they have been received by the purchaser. However, products that are damaged during shipping may be replaced.

If you receive a package that appears to have been damaged during shipment, the best way to make a return is to simply refuse delivery from the carrier. The carrier will bring these back to our warehouse; and as soon as we receive them, all charges will be credited back to your account. We will send you an email to acknowledge receipt and posting of the credit providing you have registered your email address.

If the product you ordered is not electronic and arrived in a damaged condition, you may return the item for replacement. ERG offers no replacement before receipt of the returned product; please make sure that all of the following conditions have been correctly satisfied:

The article you wish to return:
  • must not have been delivered to you electronically, must be a physical item, and must be visibly or demonstrably damaged upon your receipt of the product.
  • must be returned complete with all its parts, packing materials, manuals, and accessories.
  • must be shipped along with the original ERG return slip, which can be found on the order form provided to you within the original shipment.
  • must be sent back to ERG within ten (10) business days from the date you receive it and must be received by us within thirty (30) business days from the date you receive it.
If all these conditions are satisfied, we will replace the damaged product with the exact same product. ERG will not issue any replacements for returns that do not satisfy all the conditions indicated above. If you we do not receive your request for the return of your merchandise within the aforementioned thirty-day period, ERG will be entitled to dispose of such merchandise in its sole discretion. You are responsible for the postage and insurance of the return shipment.

ERG OFFERS NO REFUNDS, EXCHANGES, OR SUBSTITUTIONS FOR ELECTRONICALLY DELIVERED PRODUCTS OR FILES OR ANY OTHER PRODUCT DESIGNATED ON THE WEBSITE AS NON-RETURNABLE.

6. Disclaimer
The website is provided on an "as is" and "as available" basis. ERG expressly disclaims all warranties, including the warranties of merchantability, fitness for a particular purpose, and non-infringement. ERG disclaims all responsibility for any loss, injury, claim, liability, or damage of any kind resulting from, arising out of, or any way related to (a) any errors in or omissions from this website and the content, including, but not limited to, technical inaccuracies and typographical errors, (b) any third-party websites or content therein directly or indirectly accessed through links in this website, including, but not limited to, any errors in or omissions therefrom, (c) the unavailability of the website or any portion thereof, (d) your use of this website, or (e) your use of any equipment or software in connection with the website.

7. Intellectual Property
Except as expressly provided in these Terms and Conditions, nothing contained herein shall be construed as conferring any license or right--by implication, estoppel, or otherwise--under copyright or other intellectual property rights. By using the ERG website, you agree that its content is protected by copyrights, trademarks, service marks, patents, and/or other proprietary rights and laws. Except in connection with shopping or making a purchase, none of the ERG website may be copied, reproduced, distributed, republished, downloaded, displayed, posted electronically or mechanically, transmitted, recorded, in any manner photocopied, or reproduced without the prior written permission of ERG. Employment Research Group, the ERG logo, and other ERG logos and product and service names are trademarks of Employment Research Group. You agree not to display or use these marks in any manner without written permission from ERG.

8. Limitation of Liability
ERG shall not be liable for any loss, injury, claim, liability, or damage of any kind resulting from your use of the website. ERG shall not be liable for any special, direct, indirect, incidental, or consequential damages of any kind whatsoever (including, without limitation, attorneys' fees) in any way due to, resulting from, or arising in connection with the use of or inability to use the website or the content. To the extent the foregoing limitation of liability is prohibited, ERG's sole obligation to you for damages shall be limited to $100.00.

9. Hold Harmless
You agree to indemnify and hold harmless ERG and, where applicable, its officers, directors, agents, and employees, as well as others whose content appears on the ERG website, from any claim or demand, including reasonable attorney's fees, made by any third party arising out of or related in any way to your access of the website, inability to access or use the website, or any breach by you of these Terms and Conditions.

10. Disputes, Jurisdiction, and Choice of Law
You agree that any and all disputes, controversies, or claims arising under or in any way related to your relationship with ERG, including fraud in the inducement, or relating to the general validity or enforceability of any of the provisions hereof, shall be submitted to final and binding arbitration in Los Angeles, California, under the auspices and rules of the American Arbitration Association. Furthermore, the relationship between you ERG shall be governed by the laws of the State of Nevada without regard to its conflict of law provisions. If, however, a dispute arises that is required to be adjudicated in court, you and ERG agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Clark, Nevada. The failure of ERG to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision. Any legal action concerning these Terms and Conditions or the ERG website must be brought within one (1) year after the claim or cause of action arises.

11. Revisions
ERG reserves the right to change these Terms and Conditions at any time. Any revisions made by ERG to the Terms and Conditions will be effective immediately upon notice, which ERG may provide by means including, but not limited to, posting on the ERG website or via email. Your use of the ERG website after such notice will be deemed acceptance of such changes, and you agree to be bound by such revisions. You should visit the ERG website and review it periodically to determine current Terms and Conditions to which you are bound. You agree that in the event any portion of the Terms and Conditions is found to be unenforceable, the remainder of the Terms and Conditions shall remain in full force and effect.
